TERMS OF SERVICE
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of service by posting updates and changes to our website. Every time you want to order goods, please check these terms of the contract so that you understand the terms that apply!!!
GENERAL TERMS
1.1. This agreement is binding on both parties, which regulates the rights and obligations of the customer and the seller, the purchase of goods and payment terms, the responsibilities of the parties and other provisions relating to the purchase and sale made from the online store of SIA "ALMARO" www.gemstoreworld.com (-lv,-lt,-ee,-de) ( hereinafter - the Seller).
1.2. The customer agrees to the terms of this agreement by confirming it when placing an order in the online store or when registering in the online store.
1.3.When shopping in our online store, the Customer confirms that he is familiar with the terms of the Agreement, including the terms of delivery and return of goods and the Privacy Policy.
1.4 The seller has the right to change the terms of the contract, taking into account the legal requirements. The customer is informed about this through the online store or by e-mail.
BUYING AND SELLING
2.1. The buy/sale agreement is concluded when the customer:
2.1.1. Confirms the purchase in the online store (about which the customer is informed by e-mail).
2.2. The seller has made every effort to accurately represent the colors and images of the items, but we cannot guarantee that your computer's color display will accurately reflect the color of the item. Your items may vary slightly from these images. All pictures posted on our website were photographed by the Gemstore.lv team, therefore stealing and using our pictures for commercial purposes is a violation of copyright.
2.3. Product and shipping prices may change from time to time without notice. However, this change will not affect orders that have already been shipped.
2.4. The product price includes VAT 21%.
2.5.The price of the product does not include shipping and return costs. During the ordering process, you will be provided with information about our delivery options and costs.
CUSTOMER' S RIGHTS AND OBLIGATIONS
3.1. The customer must pay for the goods in accordance with the
payment terms.
3.2. The buyer undertakes to comply with these conditions, which are described in the online store and in the legal acts of the Republic of Latvia.
3.3. If the customer does not fulfill his obligations, the Seller has the right to limit or terminate cooperation with the customer immediately and without prior warning.
RIGHTS AND OBLIGATIONS OF THE SELLER
4.1. The Seller has the right to cancel the Customer 's order, if the Seller cannot contact the customer within 3 (three) working days, according to the contacts specified by the Customer.
4.2. The Seller undertakes to respect the Customer's right to data privacy, which is related to the legislation of the Republic of Latvia.
4.3. If the Seller is unable to fulfill the customer's order (deliver on time and/or deliver directly to the product that the customer has ordered), then the customer has the right to return/refuse this order and the Seller must return the money
to the buyer within 3 (three) working days, if The customer has already settled with the Seller. The exception is if the customer and the Seller have agreed with each other on another delivery time or exchanging the product for another.
4.4.The seller reserves the right to refuse an order, for example, if the item ordered is not available, if we cannot obtain payment authorization, if there is an error in the product information, including price or advertising, or if we suspect fraudulent activity.
DELIVERY AND PAYMENT TERMS
5.1. Delivery in Latvia, Lithuania, Estonia is provided by the OMNIVA and DPD post stations. Delivery worldwide is provided by official Latvian post office and DHL Express.
5.2. The goods are assembled and sent to the customer within
1-2 working days after payment.
5.3. Payment for the order is possible by credit card or automatic internet bank payment.
5.4. The customer receives the original invoice together with the ordered goods.
5.5. All disputes or disagreements, if they arise after the approval of this contract, the parties agree to resolve through negotiations. If it is not possible to resolve the creative disputes through negotiations, they will be referred to the
Riga Arbitration Court.
WARRANTY
6.1. Claims received regarding product quality will be dealt with in accordance with the norms of the Consumer Rights Protection Law (PTAL) of the Republic of Latvia, in accordance with the regulatory regulations of the Cabinet of Ministers no. 631. "Procedure, what kind of consumer's claim should
be submitted and considered for a product or service that does not comply with the terms of the contract" requirements (MK Rules No. 631).
6.2. We remind you that the PTAL norms apply to cases, if the product is purchased by a legal person.
RETURNING GOODS
7.1. Article 12 of the Law on Protection of Consumer Rights of the Republic of Latvia (PTAL) and Regulations of the Cabinet of Ministers No. 207 "Regulations on distance contracts" state that the customer has the right to withdraw from the contract within 14 (fourteen) calendar days from the day of receipt of
the order and return the product to the seller.
7.2. When returning the product, it must be unused, without defects, with the original tags of the manufacturer, in the original set and packaging.
7.3. According to PTAL Article 12, Part 6, the Buyer is responsible for keeping the returned product in the same condition as it was received. Goods are not accepted back in the following cases:
• If the product is without original tags, original packaging
or sets;
• If the product is used, with scratches, any kind of defects,
dirt, etc.;
• If the defect occurred as a result of chemical substances
or mechanical effects;
• The product has been repaired before;
• If the defect is caused by using the product for purposes
for which it is not intended;
• The product cannot be returned if it is made to individual order.
7.4 If necessary, the Customer contacts the online store.
7.5. The product must be sent to the following address: Daugavas iela 38-317, Marupe, Latvia, LV-2167 or by Omniva package -Mārupes RIMI parcel together with a completed return form.
7.6. Shipping costs for returned goods are covered by the Customer.

7.7. The money for the returned product will be credited to
your bank account within 15 (fifteen) working days (if the product does not meet the terms of the contract).
7.8. Original shipping costs are non-refundable.
EXCHANGES
8.1. If one of the ordered products did not suit you, you can exchange it for another product, at an equal or higher price, if it is available in the store. If it is
more expensive than the original purchase price before the exchange, then you have to pay the difference. In this case, the product return form must indicate the product code for which you want to exchange for. Before exchanging goods,
please inform us by phone. +371 29993910 for which exactly you want to exchange, so that we provide the specific product for you. The shipping cost of the exchange of goods shall be borne by the customer.
8.2. In cases where a product is returned that has a manufacturing defect due to inspection, or a product of an inappropriate model was sent to the customer of the gemstore.lv store, gemstore.lv compensates the customer for the
costs of the product and the costs of returning the product in the amount of 100%.
USE OF PRODUCTS
9.1.The products for sale in the online store are intended for collection, use as jewelry, talismans and interior items.
9.2.Various natural minerals (stones, crystals, etc.) may contain various metals and chemical elements, they are not intended for oral use.
9.3.It is recommended to wash your hands after contact with minerals (especially for raw minerals). Store minerals out of the reach of children.
